As a practicing Paralegal and Dispute Mediator, I have seen first hand that we live in a litigious and all too often contentious society. It seems that if somebody doesn't like something, they go to court. With this, the courts have become over-crowded, which adds the frustration and of course is much more expensive. Mediation is a voluntary, confidential process in which a neutral 3rd party (in this case the mediator) facilitates negotiation between parties to help them reach a mutually acceptable solution to their problem.

The mediator simply helps the parties communicate, evaluate their needs and interests, generate options and helps the parties craft a workable resolution.

One of great benefits of mediation is its flexibility and absence of rigid rules. A mediator has the capability to be flexible, and each mediation is conducted in a way best suited to the parties and the dispute. As a neutral third party, I am able to make the best effort possible in order to assist the parties in reaching an agreement.

In essence, mediation is assisted negotiation. The goal is not to decide who is right or wrong. Rather the persons are asked to provide a picture of the overall situation and to release any pent up emotions that may be blocking the way to resolution.

Mediation focuses primarily on mutual benefits and calls for the parties to approach the problem in a spirit of cooperation. The mediation process transforms adversaries into joint problem-solvers. The focus is not on losing or winning, but transforming the situation to maximize benefits to all.
